Terms of Service

1. Agreement

These terms are between you and Ori Hamo, Israel ("OMETZ", "we", "us"). By creating an account or using the app you accept them. If you do not accept them, do not use OMETZ.

2. Not medical advice — read this one

OMETZ is a general fitness and nutrition tool. It is not a medical device, and nothing it produces is medical advice, diagnosis, or treatment.

• Calorie and protein targets are estimates from standard formulas. They are not prescriptions and they are not right for everyone.
• Nutrition values from photo analysis, barcode lookups, and the food database are approximations and can be meaningfully wrong.
• Consult a doctor before starting any training or nutrition programme — and especially if you are pregnant or breastfeeding, are under 18, have or have had an eating disorder, have a heart condition, diabetes, or any chronic illness, or are recovering from injury or surgery.
• Lifting weights carries a risk of injury. You train at your own risk. Stop and seek medical help if something hurts.

If you may be experiencing an eating disorder, please speak to a professional rather than an app. OMETZ counts calories, and that is not appropriate for everyone.

3. Your account

• You must be at least 18 to use OMETZ.
• Keep your password to yourself. You are responsible for what happens under your account.
• One account per person. Don't share logins.
• Give accurate information about yourself — the coaching is calculated from it, so wrong inputs produce wrong targets.

4. Subscriptions and payment

How it works

• OMETZ has a free tier with a daily cap on AI coaching, and a paid Pro tier that removes the cap and unlocks adaptive targets, plan generation, photo and voice logging, and full analytics.
• Pro is sold as an auto-renewing subscription, monthly or annual, at the price shown in the app for your region.

Billing is handled by Apple

• Payment is charged to your Apple Account at confirmation of purchase.
• It renews automatically unless you turn off auto-renew at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours before the period ends.
• Manage or cancel in your device Settings → your Apple Account → Subscriptions. We cannot cancel it for you and deleting the app does not cancel it.
• Refunds are handled by Apple under their terms, not by us. We can't issue them.
• If a payment fails or a purchase is refunded, Pro features stop.

Price changes

We may change prices. An existing subscription keeps its price for the period already paid for; any change applies from the next renewal, and Apple will ask you to confirm before charging a higher amount.

5. Fair use

Don't:

• Attempt to bypass the free-tier limits, the paywall, or any rate limit.
• Automate, scrape, or hammer the API.
• Reverse engineer, resell, or redistribute the service.
• Upload anything unlawful, or anyone else's photos without their permission.
• Use the AI coach to try to extract its instructions or to generate content unrelated to training and nutrition.

We may suspend or terminate an account that does these things. If we terminate you for a material breach, you are not entitled to a refund of the current period.

6. Your content

Your logs, photos and messages remain yours. You grant us only the narrow licence needed to store and process them in order to run the service for you — nothing more. We claim no ownership and will not publish or repurpose your content.

7. Our content

The OMETZ name, the marks, the app, its design and its exercise library are ours and protected by copyright and trade mark law. You may not copy or reuse them.

8. Availability

We aim to keep OMETZ running but do not guarantee uninterrupted service. It is operated by one person on modest infrastructure. There will be maintenance and there may be outages. Features may change or be removed. If we discontinue the service entirely, we will give reasonable notice and a way to export your data.

9. Liability

To the fullest extent permitted by law, OMETZ is provided "as is" without warranties of any kind. We are not liable for indirect, incidental or consequential loss, for injury arising from exercise you chose to perform, for decisions you made based on estimated nutrition figures, or for data loss beyond our control.

Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or anything else that cannot lawfully be limited — and if you are a consumer, your statutory rights are unaffected.

10. Deleting your account

Settings → Delete account. It is immediate and permanent, across every table we hold. Deleting your account does not cancel an Apple subscription — cancel that separately in your device settings, or you will keep being charged.

11. Changes to these terms

We may update these terms. Material changes will be shown in the app before taking effect. Continuing to use OMETZ after that means you accept the new version.

12. Governing law

These terms are governed by the laws of the State of Israel, and the courts of Tel Aviv-Jaffa have exclusive jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of protections available under your local law.
